Realistically, any entrepreneur that is considering forming their own company while working for someone else can mitigate this type of issue by doing the following:
Keep regular work hours
Have separate “work” and “personal” computer/phone/etc equipment
Once you “clock out” of your day job, create a pattern of switching to the “personal” machine, do your NewCo work there, and don’t let anything cross-pollinate.
If that type of thing was done, it can be easily proven and mediated quickly.
