An HR employee has a duty to oerform their job, at least in the US, within specific confidentiality standards.
In some cases, this can mean that they will need to make a coded notation in an employee file that is only accessible by other members of HR, and not anyone outside the deparment.
From that perspective, even tbough their role derives entirely from the employer, their “duty of care” rests solely with the employee.
(Yes, even when they need to terminate them.)
